1. What This Application Is
AxleTrack is a calculation tool that computes axle weight distribution for rigid trucks and semi-trailers based on data you provide. It is a planning and verification tool to assist you in your load management decisions.
2. What This Application Is Not
AxleTrack is not:
Legal advice, compliance certification, or regulatory approval
A substitute for your professional judgment as a qualified operator
A substitute for physical weighbridge verification
Endorsed, approved, or certified by any government transport authority or regulatory body
A guarantee that your load complies with applicable laws and regulations
3. Your Responsibilities
a) Input Accuracy All calculations depend entirely on the accuracy of data you enter, including vehicle specifications, axle configurations, load weights, and load positions. You are solely responsible for ensuring all measurements and inputs are accurate. Errors in input data will result in incorrect calculations.
b) Verification Obligation You must independently verify all calculations and results. Cross-check results against physical weighbridge measurements where possible. You must ensure compliance with all applicable Commonwealth, State, and Territory transport regulations.
c) Regulatory Compliance Final responsibility for load compliance rests entirely with you as the vehicle operator. You must be familiar with and comply with all applicable Mass, Dimension and Loading (MDL) requirements for your jurisdiction and route. Regulations may change — you are responsible for staying current with applicable laws.
d) Professional Judgment This tool assists with calculations but does not replace your professional knowledge and experience. Exercise your own judgment when making loading and transport decisions. If in doubt about any load configuration, seek professional advice or weighbridge verification.
4. Limitations and Warnings
a) Application Limitations We do not warrant that the application will be available at all times, operate without interruption, or be free from bugs or errors. Results will not be accurate if incorrect, incomplete, or outdated data is entered.
b) Factors Not Accounted For This application may not account for road surface conditions, gradient, or weather effects; dynamic load shifts during transport; vehicle wear, suspension condition, or tyre pressure variations; specific permit conditions or route restrictions; load securing methods or cargo characteristics; or variations between individual vehicles of the same model.
5. Limitation of Liability
To the maximum extent permitted by law, we (the company and its directors, employees, and agents) are not liable for:
Fines, penalties, infringement notices, or regulatory action arising from your use of this application
Accidents, injuries, or property damage arising from load configurations based on this application
Vehicle damage, mechanical failures, or equipment wear resulting from loads calculated using this application
Loss of income, business interruption, or consequential losses of any kind
Any losses arising from application errors, bugs, downtime, or unavailability
You acknowledge that you use this application entirely at your own risk and accept full responsibility for all decisions made based on its outputs.
6. Consumer Law Protection
Nothing in these terms excludes, restricts, or modifies any consumer guarantee, right, or remedy that cannot be lawfully excluded under the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010) or other applicable law.
Where the Australian Consumer Law implies a guarantee or condition that cannot be excluded, and we are able to limit our liability, our liability is limited to supplying the services again or payment of the cost of having the services supplied again.
7. Indemnity
You agree to indemnify, defend, and hold harmless the company, its directors, officers, employees, and agents from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising from your use or misuse of this application; incorrect or incomplete data you provide; your failure to verify calculations or obtain weighbridge confirmation; your failure to comply with applicable transport laws and regulations; or your breach of these terms.
8. Data Privacy
Your use of this application is governed by our Privacy Policy, which explains how we collect, use, and protect your information.
9. Updates and Changes
We reserve the right to modify, update, or discontinue the application at any time without notice, and to update these terms at any time. Continued use after changes constitutes acceptance of the updated terms.
10. Professional Advice
For compliance advice specific to your vehicle, load, route, or operating conditions, we recommend consulting a qualified transport compliance consultant, your industry association, the relevant transport authority in your State or Territory, or a legal advisor specialising in transport law.
11. Governing Law
These terms are governed by the laws of New South Wales, Australia. You submit to the non-exclusive jurisdiction of the courts of New South Wales and the Commonwealth of Australia.
12. Severability
If any provision of these terms is found to be invalid or unenforceable, it will be limited to the minimum extent necessary, and the remaining provisions will remain in full force and effect.
